Abstract


Parallel imports of patented products in the case of a patent products have been protected by domestic law of a State authorized importer from abroad have legally purchased the patented product but has not been approved by the patented products imported into the country . With the accelerating pace of global economic integration , the issue of parallel importation of patented products is becoming increasingly prominent. Issue of parallel importation of patented products involving the free flow of the patented product , patent protection , and many other issues , many countries in which there is no consensus , international treaties nor the parallel importation of patented products and harmonization of rules , China's current patent law allows the parallel importation of patented products . Parallel imports of patented products can be divided into forward , reverse , devious . Its causes have economic globalization, the price difference , governmental action . Parallel importation of patented products the basic theory of exhaustion of rights theory , implied license theory, regional theory . In this paper , from a legal perspective , the main comparative analysis , examined by the European Union, the United States , Japan , and the relevant international conventions law and on the basis of analysis allows the parallel importation of the pros and cons of patented products proposed for the parallel importation of patented products in China the corresponding suggestions and countermeasures .
