Abstract


WTO members to resort to the Dispute Settlement Body (DSB) of the trade disputes relate to various areas, including agricultural trade dispute is still the most important international trade disputes. In 1995-2009, the number of agricultural trade disputes total 40.8% of the dispute, is far greater than the proportion of the world's agricultural trade. The occurrence of the research on agricultural trade dispute settlement mechanism of dispute prevention and effective resolution of disputes, so as to promote the liberalization of trade in agricultural products has important practical significance. In this paper, the 1995-2009 WTO agricultural trade dispute cases and summarized agricultural trade dispute case base, the case base, including estimates of the basic facts of the dispute and related indicators, to lay the foundation for the follow-up study of this article. In the study of the main characteristics of the agricultural trade disputes from disputes involving product characteristics, key members of the disputing parties in economic types expand obtained livestock and cash crops: agricultural trade disputes, the two together are Nearly half of such percentage, and the dispute to the development of miniaturization and integration in both directions; agricultural trade friction developed between members is still the focus of the dispute, and is also the most frequent type of dispute occurred, but at the same time more and more developing country members began to use the dispute settlement mechanism to safeguard their own interests. , We use a combination of qualitative research and quantitative research methods in the study of factors that affect agricultural trade disputes. Which both the dispute, the parties to different types of the country's economy, in a dispute plays a different role, the study sample was divided into four types, through the establishment of the index system of the influential factors using factor analysis of the four categories of agricultural trade disputes factors empirical analysis. The empirical results show that: the developed countries, whether as the prosecution or the respondent party, the contribution of agriculture to economic countries is one of the main parties to the dispute; developing countries as a prosecution or the respondent party, the National Agricultural effective political force the most important factor to affect the dispute occurred. In the WTO dispute settlement mechanism, in this article from the dispute settlement mechanism has been progress, there is still insufficient and the need to place elaborate, agricultural trade dispute settlement mechanism pave the way to a more scientific direction forward . Finally, we put forward our strategy to deal with agricultural trade disputes: the premise of comparative advantages, vigorously readjust the agricultural structure, and strive to avoid trade barriers, and flexibility in dealing with trade disputes, and promote the healthy and sustainable development of agricultural production and trade.
