Abstract


As the global adoption of the legal system an important milestone and a successful Convention on Private International Law , 1993 , the Hague Intercountry Adoption Protection of Children and Cooperation Convention has been in force across 14 years . 14 years , the existence of the Convention have changed the practice of transnational adoption status , built a by government agencies of the States Parties to the mechanisms of cooperation , greatly strengthened the protection of the interests of the child , the healthy and stable development of intercountry adoptions denied. 14 years , the achievements at the same time , the Intercountry Adoption of some deep- seated contradictions still exist ; abuse , trafficking, crimes of smuggling children still threaten the interests of children ; the same time, over time , the Convention itself, some the problem is gradually emerging countries have encountered some new problems in the compliance process . To meet these challenges , the Hague Conference on Private International Law through the convening of the Special Committee , released the report on the implementation , development of performance guide , to provide guidance for the practice of States . In September 2005 , the Permanent Bureau of the Hague Conference on Private International Law organized a second performance Special Committee , the contents of the meeting and the subsequent development of the document to be the legal outcome of the field of intercountry adoption . In this paper, of Intercountry Adoption, the field of conflict and cooperation in practical research is mainly based on the 1993 Hague Intercountry Adoption, the Protection of Children and Cooperation Convention and its follow-up the file system as the basis to explore the Convention itself as well as countries in the process of implementing the show the contradictions and conflicts , as well as the international community and the Hague Conference on Private International Law in response to these conflicts through various mechanisms, the Convention further development and improvement . The paper is divided into four chapters . The first chapters focus on the background knowledge . The second chapter focuses on intercountry adoptions conflicts and international cooperation mechanisms : both the deep-seated social conflicts , including in the process of implementing the specific conflict of laws ; the same time, international cooperation in the Hague Adoption Convention produced some explore . The third chapter discusses the results of the 2005 Special Committee , including the 2005 compliance reporting and compliance guidelines , and commentary . The fourth chapter is the reference of the above results .
