Abstract


Overseas investment insurance system as an important tool for capital-exporting countries to encourage and protect their own private foreign investment, overseas investors for the capital-exporting country government for their own political risks that may be encountered in a foreign country, to provide a guarantee or insurance, investors to the domestic investment insurance institutions to apply for insurance, if the political risk insurance, resulting in investor losses, the system to compensate for its loss by the insurance institutions. In recent years, with gradually increase of the national economic competitiveness and \From the distribution of investment in the region, China's overseas investment is a considerable part of focus in Asia, Africa and Latin area, the political instability of these areas, the legal system is incomplete, and brought a lot of political risks to overseas investors in China. Under such circumstances, China should not only actively participate in the practice of international legislation on international investment protection. The same time, we must learn from the successful experience of countries overseas investment insurance legislation, combined with the reality of China's overseas investment so as to establish China's overseas investment insurance system. In this paper, building a number of legal issues in the process of China's overseas investment insurance system to explore, provide a reference for future overseas investment insurance legislation. The full text is divided into three parts (introduction, body and conclusion), the various parts of the main contents are as follows: Introduction Part I: the body part is divided into four chapters: Chapter I talked about the need for the establishment of China's overseas investment insurance system. This chapter first an overview of the Overseas Investment Insurance, and then focus on the establishment of China's overseas investment insurance system described. The second chapter described the political risk and foreign investment insurance coverage. This chapter is divided into three sections: first, the concept and nature of political risk analysis;, MIGA and the United States, Japan and Germany's legislative practice; Third, the design concept of China's Overseas Investment Insurance coverage. The third chapter focuses on overseas investment insurance system mode selection with the right of subrogation. This chapter on the basis of a comparative analysis of the legislative practice of the United States, Japan and Germany, China's overseas investment insurance system run-based design concept of the mode selection and the right of subrogation. The fourth chapter discusses overseas investment insurance legal relationship of subject and object. This chapter around the system and binary system of the insurer in the insurance system, qualified overseas investors and qualified foreign investment issues described. The same time, on the basis of a comparative analysis of building in China's overseas investment insurance system proposed design concept. Finally, conclusions.
