Abstract


International factoring is a new kind of means of payment of international trade, it has two functions ,one as a payment ,the other as a trade financing,It is the main replacer of the traditional clearing form—“letter of credit”,Through the study on the legal nature and the institution of the international factoring by induction and comparative methods,we can prove the necessity and feasibility of developing international factoring between China and Russia and we can know the basic law framework,the operating mode of international factoring between China and Russia,and give some suggestions on perfecting the legal system of international factoring.The research aid of this paper is,under the double view of law and economics,comparative analyzing on the legal system of international factoring between two countries,interpreting the nature and the function of it and giving some new thoughts in choosing the proper means of payment of international trade between China and Russia
