Abstract


Parenthood is not only the most fundamental family ties but also the most nearest lineal relatives by blood. Paternity testing has a great effect on those that make your family harmonious,social stability,healthy growth of children. Whether decision of jury or the legal adjustment should be careful extremely. Paternity test would have only as the basis for the administration of justice, criminal investigation and identification of the relocation household and hospital use of blood typing, in 2005 China is opening up after the whole of society, and this result is also an endless stream of legal disputes. There are no explicit provisions on paternity testing in china law,which brings about abnormal applio- cable. Paternity testing is a professional technological work with highly liablity,which is related to interests of people and families and social stability.According to the case, the author analyzes some problems and make some adjustments about standardize paternity and institution of proceedine. It is the key to deal with paternity testing that we should standardize paternity test procedure,.It think about that presumption regulation if can use for the paternity testing in practice the rule of law. Finally the author proposes several countermeasures according to the questions appeared in the case, hopes the solution of the questions in the case is helpful for explicit provisions on paternity testing in China lawThis treatise is composed of two parts.:Part I: a case of paternity testing on the critical analysis of cases arising from the debate and reflect on their own.Part II: the case of the above issues as reflected in summarized, and put forward a sound proposal. The recommendations of two major areas: personal identification and paternity testing proceedings. The latter is the focus of the recommendations. At the same time, the presumption proposed and analyzed the rules are applicable to proceedings in paternity testing.
