Abstract


Since the 20th century , human beings are most proud of is the generation of computers and the Internet , of computer invention means that the arrival of the information revolution , the emergence of the Internet in turn this revolution pushed to around the world and into the social life aspects. Network era , an increasing number of network disputes be prosecuted to the court . National judges once again faced with this problem : how to determine the network infringement disputes litigation jurisdiction . Up to now, the world of a jurisdiction for internet infringement cases is still not unified , comprehensive law are just making tentative exploration . In recent years, there have been several cases involving network disputes litigation jurisdiction , the Supreme People's Court issued a judicial interpretation of two issues involving network infringement dispute litigation jurisdiction . For these provisions , the theoretical circles , there are still different views . In this paper, the method of comparative studies and case studies , trying to compare the study of some representative cases from which to explore the more reasonable network dispute litigation jurisdiction rules . The impact and challenges of traditional tort litigation jurisdiction theory from the Internet network , analyzes the judicial practice of the jurisdiction of the United States , Australia and other countries and our network disputes litigation , discussed the issues of judicial interpretation exist . On this basis , the idea of determining the of network infringement dispute litigation jurisdiction , as well as suggestions for improvement .
