Abstract


The object of larceny crime theory is one of dispute questions. In our country criminal law theorists . Along with the high speed development of our country, the recognizing of larceny crime object theory extraordinarily needs further renews and the consummation.The author through contrasts the characteristic theory which the domestic and foreign related larceny crime object has, had expounded the larceny crime object should have five basic characteristics. The author has enumerated the difficulty which in the recent years our country judicature practice appeared and has the dispute several kind of crime object, whether in detail proved each kind of special goods burglary object to constitute the larceny.To the crude oil took the larceny crime object brings the legal matter analysis, the author from the crime with the non-crime, this crime other crime, the accomplished offense attempted three aspects has carried on the proof, favors in the practice to instruct take the crude oil as burglary object case management.
