Abstract


For the minority of their own characteristics , uniform application of national law is difficult to give a true and comprehensive reflection of all ethnic groups , regions of marriage and family status . Reality Bai Ku Yao marriage is still largely affected by the adjustment of customary law . Thus, in ethnic minority areas exist side-by-side with the State Law \u0026 traditional customary law , and therefore inevitably faced with the problem of how to coordinate the relationship between customary law and state law . It is in this sense , the thesis arms Village Nandan, Guangxi Bai Ku Yao as an example of conflict and integration perspective , adhering to the diverse philosophy of law , the use of Ethnology and knowledge of jurisprudence , to elaborate Bai Ku Yao specific relationship between the content and its relationship with the national law of marriage and customary law . I first describe the specific content of the customary law of the traditional marriage , including marriage customary law , customary law of marriage , divorce customary law , customary law and state law conflict and performance analysis on this basis ; Secondly , by describing recent years, white pants Yao changing traditional marriage and customary law to reveal the conflict between the gradual integration trend , embodied in three aspects : cross-cousin cousin marriage disappear, married at age , ethnic intermarriage ; Finally, the State Law and habits law there are still part of the conflict , from the conceptual level , the legislative level , and judicial levels to make recommendations , in order to achieve the purpose of integration between the Bai Ku Yao marriage customary law with national law .
