Abstract


Deferred prosecution in foreign countries is a criminal lawsuit system in the judicial practice, is a form of prosecution cheap principle. This system in Europe and the United States, Japan and Taiwan, are widely used in our country. Our country has not established the system. But in recent years, in some parts of the procuratorial organs in China attempted to apply this system in practice, applicable object is minor and college students, has obtained the good social effect. The current our country "tempering justice with mercy" criminal policy, the deferred prosecution system is one of the forms "wide" very good. This paper will discusses the system, and so on, to illustrate the system rationality and operability in practice and its effect and value brought by the society, committed to the system in our country to establish the necessity and feasibility.
