Abstract


Chinese ancient religious rationalization is the traditional Confucian ethics and legal theory roots. As Confucius said, week prison in the second generation , Yuyu Hu Bunya . Chinese traditional legal ethics of the society is based on smallholder agriculture and patriarchal groups , then the inevitable family as a link to the \Reflected in the legal and ethical institutionally , it must be based on \Therefore , in the traditional Confucian ethics and law in the context of the law necessarily like Weber was \Therefore, our task is to abandon the traditional ethics of law , ethics law tradition beneficial for modern legal construction parts to the traditional ethics of law and contemporary legal construction of a relationship to explore the possibility of the road.
