Abstract


Dong Zhongshu trend of the times , Confucian Legal Thought on a theoretical generalization and effective absorption of Confucianism other than legal thinking, in order to form his \\His legal thought formation marks Chinese feudal orthodox legal thought established. Dong Yin and five behavioral framework Cosmic View of the feudal orthodox legal thought as the main content of the \Dong Zhongshu designed for the Chinese feudal society orthodox legal thought , as adapted to small-scale peasant -based ethics type situation ancient Chinese feudal society , ruled China for over 2000 years . After its formation and its very long historical period , the development of society has played a catalytic role in Chinese feudal society reached its heyday Tang . But with the development of commodity economy , the seeds of capitalist relations of production , such legal thinking has increasingly become the shackles of social development , hindering the modernization of Chinese society , resulting in China in modern times behind the beating , suffering from imperialist subjugation . China in ancient feudal society in modern society filled with failure and Dong design feudal orthodox legal thought are not unrelated. We have established a goal of building a socialist society ruled by law , rule of law, the first condition is to have good laws according defend, good law making must be correct and advanced law as guidance . Today, we study Dong Zhongshu 's legal thinking, evaluating its historical position is of great practical significance , will help us to establish and choose the times required legal thinking, thus promoting China's rule of law in the historical process of social construction .
