Abstract


Works of applied art double feature , both artistic and practical part in the various departments of the intellectual property law protection of areas of overlap blend , its protection has become a major problem in the field of intellectual property . How to solve this problem is the center of the contents of this article , the voluminous works of applied art , epitaxial broadly classified under a traditional protection theme (such as works of art ) can neither its nor independent own theme to protect . I believe that the proper approach is to deconstruct all intellectual achievements is called \protection field . The first chapter introduces the concept of applied art and deconstructs its practicality , artistry and originality of the three characteristics , deconstruction and on this basis to do classification finds its legal nature of the sub- part to prepare . The second chapter is the applied art protection under international law and legislative overview of some Western countries , and the United States for the typical two questions around the protected mode and legal qualitative details its legislative and judicial practice , also pointed out its shortcomings , perfect for our system to provide reference reference . The third chapter describes the legislative and judicial practice of China 's protection of works of applied art , and pointed out that the current practice of the drawbacks of where and pointed out the direction and goals for the improvement of the system of intellectual property protection of works of applied art . Corresponding chapter discusses the same around the two issues with the United States . Chapter works of applied art of intellectual property protection system on the basis of the preceding three chapters of my own design and perfect views . This article there is a \together and it evolved on the basis of \works of art protection system design .
