Abstract

The development of sports and sports socialism with Chinese characteristics to establish the new system will inevitably require a complete build with suitable sports law system. According to the Fourth Session of the Eighth NPC adopted \China's sports system is a legal construction goals. However, since 1995, \subject of law than there is a big gap, especially the theory of the weak, in large part led to the sports legislation lags behind, the direct effect of the field there is a lot of sports legal gaps, many sports after the incident, not from legal theory, be fully explained and confirmed. Thus, in the face of international and domestic markets, the rapid development of our country's accession to the WTO and Beijing's successful hosting of the 2008 Olympic Games, China's sports law research should quickly into deeper. According to Law and other departments of law development experience, to build China's sports undertakings meet the development needs of the sports law system, it is necessary to establish the Sports Law legal system in our country's position, that is, whether the status of an independent branch of law, in order to protect sports legal system reasonable, coordination and integrity, and the study and practice of sports law has important theoretical guidance value. Therefore, we can not expect to wait for a variety of sports laws and regulations to gradually improve later, and then do the summary of theoretical research, to think about what it actually is, it should be in what position, and should learn from others in the legal department of existing research results and research methods, and actively carry out exploration, which is the Sports Law Institute of the historic mission. This paper argues that sports law should be established in our legal system independent department law status, which is directly related to sports law and sports law the direction of development and progress. By the sports law rules as the basic material, sports legal principles as a guide elements arising from sports law system, is consistent with national and international sports development in the new situation of law system in order to maintain the rapid and healthy development of sports law. Sports Law establishing the status of the legal system is built to adapt to the development needs of China's sports undertakings inevitable requirement of sports law system, should serve as an important topic of sports law research. In our legal system has improved constantly period to community sports law needs as the starting point, scientific and reasonable to establish sports law in our legal system independent department law status of the Sports Law direction of development and progress, with a theoretical guidance value.
