Abstract


Personal information has been showing the value in the information age. In the protection of personal information security has been firmly established today, China’s "Personal Information Protection Act" has not introduced, which can not be said to be a deficiency. Inadequate protection of personal information, leading to a real life case of repeated violations of personal information, which brought to the personal information of the main sense of insecurity, not only hindered the normal value of personal information to achieve, and not conducive to China Information Society building. Although our academic legal protection of personal information with certain research, but the basic theory of personal information, current situation analysis and the construction of legislation there is no uniform mode of understanding, still to be understanding. This article is divided into four chapters to elaborate.Firstly, the chapter explains the basic theory of personal information. Respectively, the concept of personal information, content, features, theoretical basis, introduced the principle of protection; explained the need for legal protection of personal information, legal protection of personal information consistent with the concept of human rights protection is a necessary requirement for the information age, but also with international standards important manifestation. And it is also the need of preventing infringement of personal information.Secondly, this chapter examines the situation of foreign personal information legislation. EU as a pioneer of personal information legislation, there are a lot we can learn from, and also introduces an overview of the United States and Japan, and by comparison, screening, according to our present situation, where we can learn.Thirdly, this chapter examines the status of protection of personal information. Start from the following: protection of personal information about our current legal rules, not the system of the legal system, but the provisions were made sporadically. Describes the personal information protection in Liaoning Province, the results achieved.lastly, comprehensive discussion of the previous chapters, this chapter mainly from the two made my view: First,we must build legislative model of personal information, no system is stable if the model legislation will be difficult to effectively start, will give future Legal implementation of the buried hazards. Therefore require personal information legislation Mode. Infringement of personal information for the current situation but the description and analysis, the protection of personal information security countermeasures.
