Abstract


Everyone has personal information, personal information related to all aspects of the individual. In the information society, the network as the Information Age is the main carrier, which contains personal information that is difficult to count. In a market economy, the personal information of value to become the object of everyone wants to have. The Government of Sweden is the first legislation of personal information. After Sweden, the legislation on the protection of personal information worldwide is also unfolding on a global scale there are more than 50 countries and regions of personal information is specific legislation. The legislation of the European Union, the United States and Japan and other countries on the protection of personal information are more mature, while China has yet to have a special legal protection of personal information and the protection of personal information in dispersed form found in various laws and regulations. In the real needs legislation to protect personal information is imperative. This article is divided into five parts to discuss the protection of personal information, in the first part of this paper describes the personal information classification, the concept of the difference between the way of personal information have been infringed, personal information principle of tort liabilities, violations of the constituent elements of personal information. In the introduction to this chapter, we have a general understanding of personal information. The second part describes the need for legislation to protect personal information in our country; the third part of the paper on the basis of the analysis of the legislative model of personal information on the European Union, the United States, Japan, combined with the actual situation in China, summed up a suitable China in the mode adopted legislation to protect personal information. The fourth part of the existing legislation on the protection of personal information in China cited; summarizes the protection of personal information at the legislative level, to oversee the relief level, Internet management at the institutional level, the level of industry self-regulation system and citizens' personal information protection level of consciousness inadequate. The fifth part of the measures to be taken to enhance China's protection of personal information, such as China to develop specific Personal Information Protection Act, the establishment of specialized personal information regulators to strengthen supervision of Internet service providers, government Internet properly developed to guide and enhance the awareness of the protection of citizens' personal information. This paper presents the problems of our country in the protection of personal information, pointed out that the protection of personal information in the lack of legislative, regulatory and other aspects, and proposed concrete measures for the solution of these problems, I hope to make some contribution to the protection of personal information .
