Abstract


Determine the characteristics of the sports industry can not just rely on their mandatory law or principle by relying on the provisions are not binding, it must be mandatory and the characteristics of the combination of guidance, the development of sports industry to develop consistent rules of law. This paper describes the concept of China’s sports industry and current situation analysis study describes the status of legislation in the sports industry, sports industry legislation is lagging behind, the sports industry legislation with the legislative process moves forward and continues to improve, but still far from perfect. This article points out the problems in the sports industry in China are:laws and regulations lag behind the sports industry; supporting the sports industry to promote a serious lack of laws and regulations; laws and regulations are too poor operational principles. As the sports industry in China is unprecedented, and the rapid pace of development so that legislators can not be a good measure of control over the legal forward-looking, so the inevitable happened and the new law has been conflict between the laws. At the same time, the paper also abroad in this regard were introduced legislation designed to make people understand more about the sports industry, the basic legislation, as well as learn from foreign experience in the sports industry best legislation for improving the construction of the proposed regulations some of the sports industry theory of reference. Based on the above analysis and draw on analysis of the pattern of the sports industry and improvement of legislative methods, discusses the progress of legislation in the direction of the sports industry, recommended the development of China’s "Sports Industry Promotion Law"."Sports Industry Promotion Law" shall refer to the legislative structure of the industry to promote the general law, the basic content should include general principles, financial support, technical support, market development, social services. In the "Sports Industry Promotion Law" by-laws should state the legal status of some of the other sports industry and the relationship between law.
