Abstract


When the 17th national congress of Chinese Communist Party deployed socialist political construction, it put the development of grassroots democracy and the security people enjoying more tangible democratic rights as a basic project of socialist democratic politics development to advance, so the development of grassroots democracy and the civil rights realization have become the subject of many scholars and experts growing concern. Civil rights as an important content of the development of democracy at the grassroots level, its realization needs rights granted, rights claim, rights security and relief processes, in which the initiative rights expression and proposition of citizens is an important link of realizing civil rights.Along with the gradual establishment of modern legal society, China’s urban and rural residents change or have changed. They have more diversity path selections in the maintenance of their interests and seeking for survival and development opportunity, and their individual independent consciousness and rights consciousness have gradually strengthened, their rights expression and rights protection act have more diversified, residents are gradually developing into citizens, and their rights claim are gradually growing. How to explain and analyze this phenomenon from theoretical level, and to grasp the civil rights claim operational logic and to analyze its problems, in order to better promote grassroots democracy development are the main research contents of this paper.Civil rights from text to practice process, it does not often fully follow the orientation of the national legal system framer, that is to say the anticipating of the law system can not fully satisfy citizens and make they take proper action to achieve citizenship. The realization of citizens’ rights is affected by two factors, on the one hand, it is the rights subject-citizen’s behavior choice when they face law system; The other is the fit-to-purpose between the civil rights of law system grant and the grassroots reality, when the legal system encounters grassroots reality, it can unfold according to its special logic.This paper will be combined with text material and grassroots practice, through analyzing the rights consciousness and behavior of rights claim, and examine citizens’ rights claim generating logic and its present situation; this paper will be combined with legal system and grassroots practice, and will discuss the civil rights claim and status in the practice of democracy at the grassroots level development; it will combination cases study to further investigate Chinese citizens often appearing dilemma of rights claims-they have rights consciousness but no expression; they have unconscious rights expression and they have neither rights consciousness nor rights expression and so on problems and to analyze reasons, in order to citizens rights claim can promote grassroots democracy development.
