Abstract


The judicial committee system is our unique system of judicial trial . Over the years , as the highest judicial organization within the People's Court , the Judicial Committee in summary of trial experience , unified standards of justice , to ensure the quality of case handling and achieve justice play an important role . However, with the deepening of China's economic , social development and judicial reform , the existing judicial committee system has been unable to fully adapt to the changed situation requires , highlighting the judicial committee composed unreasonable to discuss the cases of violation of due process , the challenge system scarcity to discuss cases such as an excessive number of drawbacks. This problem has attracted the attention and consideration of the judiciary and the legal community for reform and the abolition of the system of judicial committee to carry out a long-term discussion . In this context , the Supreme Court in 2005 the implementation of the \the criticism of the shortcomings of the sound is still prevalent. The mission of this article is to retain judicial committee system under the premise , combined with the author many years of experience in the work of the Court , from the perspective of a judge to carry out a detailed inspection of our unique system of judicial committee to analyze the advantages of the system and its shortcomings re- analysis and evaluation , focused on the reform of the system , combined with the actual proposed organization should establish and improve the judicial committee , scientific orientation and integration of the various functions of the judicial committee , to standardize the operational procedures of the system , established avoidance system and misjudged cases accountability system and other reform measures , look forward to the improvement of the system benefit , at the same time and ask for advice .
