Abstract


Based on the need to maintain the concept of fairness and justice , in order to meet the kind of expectation of the plight of victims of acts of state , the state through certain procedures should be imposed on the criminal victims relief . This paper is divided into four parts , the basic idea is as follows : starting from a system built principle and reality issues , discusses the origins and development of the criminal victims assistance system ; extraterritorial related systems , international guidelines for the investigation, evaluation ; exploring the theoretical basis for the national relief system for Victims of Crime and analysis system ought to function on the basis of seeking viable options , building the criminal victims assistance system suited to China's realities , from both the macro and micro aspects . The innovation of this paper is mainly reflected in three aspects . First, the theoretical basis of the criminal victims relief remodeling. One by one comment on the basis of academic major theoretical basis of the theory of State responsibility for the two wings of the interests of social welfare theory and utilitarian theory of the \Second, the related concepts of criminal victims relief made ??meticulous clarify . Strict definition of the meaning of the system for Victims of Crime , crime , national compensation with the State aid system combing their social assistance , victim assistance , criminal protection of victims of criminal procedure to determine the relief system of criminal victims in the power of the state . caused by the loss of victim compensation and assistance for offenses under the criminal law . Third, build the criminal victims assistance system with Chinese characteristics is divided into macro and micro level discussion focused on the content of other state aid in addition to the compensation from the State , the binary relief agencies in charge of setting the bailout program , as well as emergency relief system discussion of the practical issues of design .
