Abstract


In this paper, the general theory of risk responsibility and national legislation mode of dangerous responsibility concept , function , theoretical basis , causality determination of contributory negligence , Disclaimer grounds , common risk liability and other basic theory , pointing out that two legislative model their pros and cons. Embarrassment and distress situation look dangerous liability in tort , and its true home is the Social Security Act . On this basis , for the the dangerous responsibility legislative situation in China , the paper concludes with their own legislative proposals .
