Abstract

Emissions trading system created its theoretical basis: the basis of economic theory, including the theory of externalities, the Coase theorem, the public goods nature of environmental capacity of scarce resources. The legal theory is based primarily on the theory of property rights. Emissions trading represents a new institutional arrangements in the field of environmental management, its superiority is to stimulate polluters to achieve higher environmental protection at a relatively low cost. The United States as early as the 1970s began trading scheme for theoretical research, and gradually introduce emissions trading practice, there are two forms of emissions credit trading and waste discharge permit trading. U.S. sulfur dioxide emission permit trading system policy is by far the most extensive, the most significant effect of the emissions trading practice. To the beginning of the 21st century, a growing number of countries and regions in the emissions trading system to solve the problem of environmental pollution, such as Germany, the United Kingdom, Singapore. Analyzed and summarized the practice of other countries of the world, emissions trading and its effects can provide reference for the construction of China's Emission Trading System. In China, the emissions trading pilot began in the early 1990s, in theory, have also made some achievements, the sulfur dioxide emissions trading pilot especially power industry there have been some success stories, the industry characteristics of the electric power industry and policy status quo is very suitable for carrying out the sulfur dioxide emissions trading industry. By the pilot, the establishment of the system is also exposed many problems, such as the immaturity of the market mechanism, the lack of a clear trading rules, legislation and policy lags behind reality need. Currently, national laws and regulations have not been worked out yet, the formation of the emissions trading system system, the entire system is still under development.
